(August 6)[Notes:ANCHOR VOICE] [Notes:VO--GUANTANAMO BAY/COURTROOM SKETCHES]AT THE FIRST U.S. WAR CRIMES TRIAL SINCE WORLD WAR II -- A PANEL OF SIX OFFICERS DELIVERED A SPLIT VERDICT IN THE TRIAL OF OSAMA BIN LADEN'S DRIVER -- SALIM HAMDAN (sah-LEEM' hahm-DAHN') -- FINDING HIM GUILTY OF AIDING TERRORISM -- BUT AQUITTING HIM OF TWO MORE SERIOUS CHARGES OF CONSPIRING TO ATTACK THE U.S.DEFENSE ATTORNEYS HAVE LONG ARGUED THE TRIALS ARE UNFAIR AND VIOLATE THE U.S. CONSITITUTION - BUT WEDNESDAY -- HIS DEFENSE TEAM APPLAUDED THE JURY'S DECISION ON THE CONSPIRACY CHARGES. [Notes:SOT --HARRY SCHNEIDER/DEFENSE ATTORNEY] I would have to think that given the case that was put on...it had to be an unwelcome development for the prosecution. [Notes:VO--COURT SKETCHES/HAMDAN]HAMDAN'S ATTORNEYS SAY BEFORE THE U.S. SUPREME COURT RULED THE BUSH ADMINISTRATION'S FIRST ATTEMPT AT THE MILITARY TRIBUNAL SYSTEM WAS UNCONSTITUTIONAL -- HAMDAN FACED CONSPIRACY CHARGES ALONE.BUT THEY SAY PROSECUTORS TACKED ON THE AIDING TERRORISM CHARGES IN THE MONTHS AFTER THE SUPREME COURT'S DECISION -- WHEN THE BUSH ADMINISTRATION RE-WROTE THE RULES. [Notes:SOT --CHARLES SWIFT/DEFENSE ATTORNEY] The problem is that the law was specifically written after the fact to target mr. Supreme Court Rules in Favor of Gitmo Detainees PlusSupreme Court Rules in Favor of Gitmo DetaineesSupreme Court Rules in Favor of Gitmo DetaineesThe Associated PressThe Supreme Court ruled Thursday that foreign terrorism suspects held at Guantanamo Bay may challenge their detention in U.S. civilian courts. The court ruled 5-4 that the government is violating the constitutional rights of prisoners. (June 12)A divided Supreme Court says foreign terror suspects held at Guantanamo Bay have the right to challenge their detention in civilian courts. It's the third high court ruling on the subject. The previous two times, the administration and the Republican-controlled Congress changed the law to block detainees from court.Writing for the five-four majority, Justice Anthony Kennedy said: "THE LAWS AND CONSTITUTION ARE DESIGNED TO SURVIVE, AND REMAIN IN FORCE, IN EXTRAORDINARY TIMES."(SOT: MICHAEL RATNER/CENTER FOR CONSTITUTIONAL RIGHTS)(13:06:35) I HAD TEARS IN MY EYES. I JUST THINK IT'S THE MOST CRITICAL DECISION WE'VE WON IN YEARS AND HOPEFULLY BEGINS TO END REALLY THE EXCESSES OF THE SO CALLED WAR ON TERROR OF THIS ADMINISTRATION. The Center for Constitutional Rights represents many of the 270 men still held at the U-S Naval base in Cuba. Among the prisoners are men considered high-value targets. They including Khalid Sheik Mohammad, who the government says was the mastermind of the September 11th attacks. (SOT: MICHAEL RATNER)(13:07:38) I THINK THE HIGH MAJORITY OF PEOPLE AT GUANTANAMO WILL BE FREED BECAUSE THE GOVERNMENT JUST DOES NOT HAVE THE EVIDENCE TO HOLD THEM. In Rome, President Bush said he will look into whether new legislation is appropriate.(SOT: PRESIDENT BUSH)(13:50:12) AS TO THE SUPREME COURT'S DECISION. WE'LL ABIDE BY THE SUPREME COURT'S DECISION. THAT DOESN'T MEAN I HAVE TO AGREE WITH IT. THIS IS A DEEPLY DIVIDED COURT AND I STRONGLY AGREE WITH THOSE WHO DISSENTED. The courts most conservative members dissented. Antonin Scalia wrote that the U-S is 'at war with radical Islamists" and that the court's decision "will make the war harder on us. It will almost certainly cause more Americans to be killed."It's not clear whether the ruling will lead to prompt hearings for the detainees. Federal judges are scrambling to read the decision and figure out how to proceed. ___ ___, The Associated Press. Tags: scotus guantanamo supreme court favor gitmo detainees |

US Asks to Rewrite Gitmo Detainee Evidence PlusUS Asks to Rewrite Gitmo Detainee EvidenceUS Asks to Rewrite Gitmo Detainee EvidenceThe Associated PressThe Bush administration wants to rewrite the official evidence against Guantanamo Bay detainees, allowing it to shore up its cases before they come under scrutiny by civilian judges for the first time. (June 20)[Notes:ANCHOR VOICE] [Notes:guantanamo file]For years, the U-S government has stood behind the evidence it used to hold detainees at Guantanamo Bay. But now that those prisoners have the right to challenge their detention, the Bush administration wants to rewrite the evidence.Government lawyers say they want more time to add new details and make other changes to their cases before those hearings begin.SOTMatt Apuzzo/The Associated Press"there's an argument to be made that really you're just moving from one court to another and so you need to make a few changes. But certainly the attorneys for the detainees think this is absolutely indicative that they don't believe their own evidence."Earlier this month, the Supreme Court cleared the way for detainees to challenge their detention in civilian court. Attorneys for the detainees say the government's request is proof that the evidence is flimsy.SOTDavid Remes/Detainee Attorney 32:06 at this stage of the game, it's sort of an admission that the original returns were defective, and also an admission that the government thinks it needs to beef up evidence it originally presented in order to justify holding these men [Notes:video of documents]The government's case is laid out in documents called factual returns.Federal judges will decide whether the Justice Department can rewrite the documents. The Justice Department had no comment. The Supreme Court's ruling was a blow to the Bush administration, which has long been criticized for detaining prisoners at Guantanamo.SOTMatt Apuzzo/The Associated Press"No doubt the government didnot want to go to court on this. They have been fighting this every step of the way" The ruling means federal judges could end up ordering some detainees to be released. However, those orders will depend on security concerns. ___ ___, The Associated Press. Tags: guantanamo evidence us asks rewrite gitmo detainee |

Tour of Gitmo on the Platte More at http://www.theuptake.org. After the site and interior of the secret detention center in Denver, developed in anticipation of the DNC, was exposed, the Sheriff's Office decided they may as well give the media a tour to reassure public sentiment. Undersheriff Bill Lovingier showed TV, newspaper, radio, and new media around the facility, walking through the process a detainee would face. One change made to the facility because of the media coverage and resulting community outrage is the removal of razor wire on the interior holding pens. Lovingier explains the change and why the extra security is needed within the facility not just to prevent people from escaping, but also to prevent protest and counter-protest groups from clashing violently while being held. The ACLU has raised a concern about the process, saying Colorado law requires lawyers to meet with their clients within the detention center. Lovingier sidestepped a question about this, saying only "you're correct, that is what the ACLU has said." 'Gitmo On The Platte' Set As Holding Cell For DNC The United States government already acknowledges the existence of secret prisons in foreign countries used for "extraordinary rendition" so that prisoners can be tortured beyond the access of the U.S. courts. Now our lords and masters are bringing the first secret prisons and concentration camps to the United States itself, all for the benefit of the Funky Monkey, to protect him from nasty and hurtful criticism at his coronation that might kill his buzz. Wouldn't want to upset de Head Nigga in Charge, now would we? The Denver police admit that they have established a secret prison for protestors and other Enemies of the People arrested at the Democratic national convention next week, who might be prone to mar the coronation of the Funky Monkey with unseemly questions and noise. Channel 9 News in Denver reports that "The makeshift holding center, dubbed Gitmo on the Platte by activists, is located on city-owned property near Steele Street and 38th Avenue. Newly-installed security cameras guard the exterior, chain-link fences and barbed wire form cells inside. "We feel the city should be ashamed of this secret prison they've set up," said Re-create '68 organizer Glenn Spagnuolo. "The public was never going to view this place, it was just found out. They got caught with this place. They told our lawyers in negotiations that this place didn't even exist...What's going to happen here is police are going to detain people for an inordinate amount of time. They're going to use this as an excuse to keep people out of the courts and off of the streets." Looks like we're already getting our first taste of black rule, even before mah nigga done eben be coronated. The names Mugabe, Bokassa, Idi Amin ring a bell? If this monkoid has enough juice to create his own private little concentration camp in an American city even before the little formality of being elected, what will it be like when the primate becomes President? http://cbs4denver.com/denver2008/denver.protesters.arrested.2.793930.html 'Gitmo On The Platte' Set As Holding Cell For DNC Written By Rick Sallinger Section: Democratic National Convention Section Reporting Rick Sallinger DENVER (CBS4) ― CBS4 News has learned if mass arrests happen at the Democratic Convention, those taken into custody will be jailed in a warehouse owned by the City of Denver. Investigator Rick Sallinger discovered the location and managed to get inside for a look. The newly created lockup is on the northeast side of Denver. Protesters have already given this place a name: "Gitmo on the Platte." Inside are dozens are metal cages. They are made out of chain link fence material and topped by rolls of barbed wire. "This is a secured environment," Capt. Frank Gale of the Denver Sheriff's Department told CBS4. "We're concerned about how that's going to be utilized by people who will be potentially disruptive." In past conventions, mass arrests have taken place. With Denver's jails already overflowing, new space had to be created and officers trained. Each of the fenced areas is about 5 yards by 5 yards and there is a lock on the door. A sign on the wall reads "Warning! Electric stun devices used in this facility." CBS4 showed its video to leaders of groups that plan to demonstrate during the convention. "Very bare bones and very reminiscent of a political prisoner camp or a concentration camp," said Zoe Williams of Code Pink. Williams was one of those arrested at the Republican Convention in New York in 2004. "That's how you treat cattle," said Adam Jung of the group Tent State University. "You showed the sign where it said stun gun in use and you just change the word gun for bolt and it's a meat processing plant." Gale would not discuss the facility at this time. "We want to make sure we got our game plan set," he said, "We want to make sure the entire procedure is laid out all the personnel know what they are supposed to do." The plans were to keep this lockup a secret, at least for now. The sheriff's department said late Tuesday the mayor's office would be releasing a statement about it early next week. The American Civil Liberties Union is asking the City of Denver how prisoners will get access to food and water, bathrooms, telephones, plus medical care, and if there will be a place to meet with attorneys. Mayor's Office News Release On Wednesday afternoon Mayor John Hickenlooper's office sent a news release to CBS4 and other media explaining the purpose of the holding facility. It says there will be a community outreach program this week to explain the facility's function.
