Support the Constitution, free PFC James Burmeister Today is the 4th of July, 2008, about 9 pm when firework displays usually start. We will not attend these. As Veterans for Peace we reject these simulations of war, which should not be used to celebrate or represent our country. This pervasive symbolism in America that glamorizes and sanitizes violence, together with dehumanization of other peoples such as the Vietnamese 40 years ago and Arabs today, contributes to the moral apathy of Americans as we attack, occupy and lay waste to the nation and people of Iraq. Our seizure of Iraq violates international laws which prohibit aggressive war, laws to which we are bound by our Constitution which declares our treaty obligations the "supreme law of the land." These include the United Nations Charter. Upon joining the military we swore an oath "to support and defend the Constitution of the United States." Yet today, American soldiers are being prosecuted for doing just that. On July 16, a 23-year old soldier from our city, PFC James Burmeister, will face a special court-martial for desertion at Ft. Knox, KY, threatened with prison, dishonorable discharge and loss of VA care for his PTSD and residual effects of brain injury from a roadside bomb. Burmeister joined the military naively accepting the recruiter's assurance that he would be doing "humanitarian" work such as delivering food and restoring infrastructure. However, he was soon puzzled to find himself in training to raid and ransack the private homes of Iraqi citizens. His duty assignments in Iraq eventually included "bait and kill" operations that lured Iraqis into the open to retrieve apparently abandoned US military equipment such as cameras, where they were then killed by snipers. Victims were almost always unarmed, not identified as combatants, and were sometimes children. As a normal man with a normal conscience, Burmeister recognized that he was witnessing and being directed to participate in war crimes. This disturbed him deeply. He talked about it, applied to become a conscientious objector, and when denied this, went AWOL to Canada in May 2007 which after 30 days became desertion. In June 2007 Burmeister reported these war crimes to CBC news in Canada, and they were later confirmed in a Washington Post story in September 2007. As a whistleblower, Burmeister deserves our gratitude and support in restoring the rule of law to our country. We believe that PFC Burmeister has a strong legal defense based on the following seven points: 1. Upon joining the military, Burmeister swore to "support and defend the Constitution of the United States." 2. Article VI, Paragraph 2 of the United States Constitution, which Burmeister is sworn to defend, requires our government to comply with its treaty obligations. 3. U.S. treaty obligations include the Nuremberg Charter establishing that following orders does not excuse war crimes. 4. This principle is incorporated into the Uniform Code of Military Justice, which states that American military personnel have not only the right but the duty to refuse illegal orders. An order to commit war crimes is an illegal order. 5. U.S. treaty obligations also include the Fourth Geneva Convention that specifies the responsibilities of an occupying power for the welfare of a population occupied. This requires us to protect, not "bait and kill," citizens under occupation. 6. Burmeister was denied his right and duty to refuse illegal orders under the UCMJ, and was thereby forced by his commanders into the action he took: refusing illegal orders "with his feet" after attempting to do so through normal channels of communication with his commanders. 7. Burmeister's actions precisely fulfilled his oath to defend the Constitution by adhering to international law, and his duty under the Uniform Code of Military Justice. As U.S. Army veterans and American citizens, we therefore urge that PFC Burmeister be found not guilty of desertion under the Nuremberg Principle of the UCMJ, receive an honorable discharge, and receive full veterans benefits including VA treatment of his physical and psychological injuries suffered in the line of duty. More complete information on PFC James Burmeister can be found at this link: http://veteransforpeace.net/forum/viewtopic.php?t=100 Tags: James Burmeister AWOL desertion war crimes bait and kill winter soldier Constitution International Law |

Taser torture witness at press conference In a town already cursed with a reputation for police brutality, comes an outrageous incident that sounds more like the workings of Gestapo thugs, than officers of the peace. During a very peaceful rally in downtown Eugene on May 30th, 2008 to support the elimination of roadside pesticide spraying, police officers targeted one of the participants and subdued him, beat him, and tasered him at least three times. Fortunately for those of us who are concerned about past occurrences of police brutality and non discretionary use of tasers, this incident was witnessed by around twenty people, and partially captured by photographs and video. Use of tasers in our community is new and very controversial due to the potential for abuse by overzealous officers. That an investigation is needed is obvious. Whether a thorough one is conducted or not will be a test of the recent voter demand for more oversight of the Eugene Police Department. Though the voters have demanded this oversight be provided, it is not certain that this will occur. With the recent character attacks from the local Police Union website directed at Councilwoman Bonnie Bettman who has been pushing for independent oversight of the Eugene Police, one need not be much of a detective to figure out why she is being attacked. These attacks are dangerous to us all. In my opinion, this independent oversight is long overdue, following a string of events where police officers seemed only too eager to use unnecessary force. Macing protesters up in trees, abusing vulnerable women which ended up costing our city millions of dollars to settle in court, killing an emotionally disturbed teenager armed with only a knife are a few of the most disturbing events. Amazingly, as the city gave these officers an award for killing the teenager, the killer professed that he was "humbled and honored". Is this really our Eugene? Unfortunately, yes. We have a big problem and we need everyone's help. It is possible to correct this local outrage, but only if community support comes forward. The students who need our support are asking us to aggressively write letters and make phone calls for now. FYI, here are some valuable leads: Letters to the Editor, Register Guard mailto:rgletters@guardnet.com main newspaper, comments limited to 250 words, must include full name, address and phone Letters to the Editor, Eugene Weekly mailto:editor@eugeneweekly.com local progressive newspaper, comments limited to 250 words, must include full name, address and phone. The Spirit of Newport Oregon Squadron13 captures the spirit of Newport Loyalty Days Parade viewers on video. It was just one year ago that we were kicked out of this parade and were told by city representatives that our "message didn't fit the spirit of the community". We felt VERY welcome this time as this collection of short video clips shows. The response was overwhelmingly positive, with only one report of a middle finger salute after the parade, a couple who turned their backs to us, and many, many hundreds of encouraging waves, thumbs up, I love you hand signs, and peace signs. Media Abandons Winter Soldiers The American mainstream media was conspicuously absent from the Winter Soldier event in Silver Springs on March 13-16 as noticed by three attendees in a video that was taken at the event. Does the media really support the troops or does the media ignore the troops? The Winter Soldiers, some of them active duty, all of them veterans of the Iraq and Afghanistan war, people who were there, are speaking. Who is listening? Who really supports the troops? IVAW seizes National Archives Building CLICK HERE FOR MORE TEXT INFO: IVAW members seize National Archives Building on March 19th, 2008 in front of hundreds of surprised museum visitors. Response from visitors including teachers, students, vacationers was highly positive though there were a few horrified faces in the crowd. IVAW read the terms of our Citizens Arrest Warrant and stood their ground for 90 minutes. They were allowed to leave without being arrested in one of the most spectacular CD events I've ever witnessed. Next stop was the Justice Department where the call for Bush and Cheney arrest was repeated, and then the White House where similar demands were made. This action comes on the heels of IVAW's Winter Soldier Investigation: Iraq and Afghanistan, held at the National Labor College in Silver Springs, M.D. on March 13-16, 2008, where these and many other vets from the Iraq and Afghanistan war testified about their experiences.
